What is Asylum Law

Asylum law is for those who have run away from their country of origin because of past persecution, and who are looking for safety in the United States. We represent clients in immigration court as well as before the Asylum Office.

Asylum is not available to all immigrants. For example, in order to qualify, you must provide sufficient evidence substantiating to one of the following:

  • You are a refugee 

  • You are unable or unwilling to return to your country of nationality.

  • You are in danger of death, harm, or unjust imprisonment if you return to your country of birth. 

  • Your inability or unwillingness to return to your country of nationality is due to persecution or a well-founded fear of persecution on account of your racial background, religious affiliation, sexual orientation, nationality, membership in a particular social group, and so forth.

If you are a member of the lesbian, gay, bisexual, transgender, and queer (LGBTQ) community suffering from persecution or a well-founded fear of future persecution, then you may be eligible to seek asylum. According to U.S. immigration law, individuals identifying as LGBTQ would be eligible to seek asylum since they belong to a group of individuals who share a characteristic that has been persecuted because of their membership in that group. Individuals who are transgender, homosexual, or queer would be considered members of a qualifying group for asylum. 

The primary objective for someone seeking asylum is to obtain a level of protection from the U.S. government so that they will not be forced to return to their home country. Members of the LGBTQ community seek asylum oftentimes due to chronic harassment, physical violence, and persecution in their home country. Please note that it is best to file the requisite documentation seeking asylum within one year of your entry into the United States. 

The Asylum Process

 

The procedural steps necessary to apply for asylum include completing Form I-589, a document created and maintained by U.S. Customs and Immigration Services (USCIS). Once the Form I-589 is filed, you will be contacted for a USCIS interview (please note that it will typically take between one and three months after filing your I-589 to hear from USCIS). If you are in Immigration Court, your case will be filed with the court directly. 

If the USCIS officer is satisfied that you have a legitimate claim for asylum, they will typically approve it. However, if there is any uncertainty or red flags raised by the officer, then your asylum case will be referred to a court for review and decision. This is a big reason why it is so important to have an experienced asylum lawyer on your side, ready to advocate for you. Retaining an asylum lawyer is also helpful during the preliminary phase of the process since an attorney can assist with compiling relevant documents, key pieces of evidence, and can offer guidance in properly completing the aforementioned Form I-589.
